These Terms of Service ("Terms") are a binding agreement between you and Foxx Designs LLC ("Poursuit," "we," "us"), which operates the Poursuit application and website. By creating an account or using Poursuit, you agree to these Terms. If you do not agree, do not use Poursuit.
You must be at least 21 years old (the legal drinking age in the United States) to use Poursuit. Poursuit centers on venues that serve alcohol and is not directed to anyone under 21. By using Poursuit you represent that you are 21 or older and that you can form a binding contract with us.
You are responsible for the information you provide, for activity under your account, and for keeping your login secure. Provide accurate information and keep it current. You may delete your account at any time in the app (Settings → Delete Account) or by emailing support@poursuit.app.
Full access to Poursuit — live happy hours, the map, and Break the Ice — requires a Poursuit+ subscription. Two options are offered: a monthly plan and a yearly plan, each with a one-time free trial for new subscribers. Current prices and trial lengths are shown in the app before you subscribe.
Billing. Subscriptions are purchased through, and billed by, the Apple App Store or Google Play, under their terms. Poursuit never receives or stores your payment card details. Your free trial converts to a paid subscription at the end of the trial unless you cancel before it ends. Subscriptions renew automatically at the then-current price for the same term unless you cancel at least 24 hours before the end of the current period.
Cancellation and refunds. You can cancel at any time in your App Store or Google Play account settings (in the app: Settings → Manage subscription). Cancellation stops future renewals; you keep access until the end of the period you have already paid for. Refunds are handled by Apple or Google under their policies; we cannot issue refunds for purchases made through the stores.
Trials. Free trials are limited to one per person. Starting a trial on one plan and then switching to the other plan does not start a new trial.
Price changes. We may change subscription prices for future periods. If a price increase applies to you, you will be notified in advance by the store, and your continued subscription after the change takes effect means you accept the new price.
Access. Poursuit+ is for your personal use on devices signed in to your account. A subscription does not affect any venue's ranking, ordering, or prominence in the app.
Poursuit aggregates and derives venue information — including happy-hour times, prices, deals, menus, hours, locations, and contact details — from third-party sources, automated extraction, and venue submissions. THIS INFORMATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, RELIABILITY, CURRENCY, TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. Venue details change frequently and without notice. You should independently confirm any information — especially happy-hour times, prices, and deals — directly with the venue before relying on it. We do not guarantee that any venue will honor any deal, price, time, or offer displayed in the app.
You agree not to: use Poursuit for any unlawful purpose; harass, threaten, abuse, stalk, or harm another user; impersonate anyone or misrepresent your identity or age; scrape, copy, or resell our data; interfere with or attempt to breach the security of the app; or use the app in any way that could harm Poursuit or its users. We may suspend or remove accounts that violate these Terms.
Poursuit includes optional social features (such as "Break the Ice") that let users who are present at the same venue discover and interact with one another, and that may lead to in-person contact. WE DO NOT CONDUCT BACKGROUND OR IDENTITY CHECKS ON USERS AND DO NOT VERIFY THE IDENTITY, AGE, STATEMENTS, OR INTENTIONS OF ANY USER. We are not responsible for the conduct of any user, online or offline. YOU INTERACT WITH, AND CHOOSE TO MEET, OTHER USERS ENTIRELY AT YOUR OWN RISK. We strongly encourage meeting only in public places and taking sensible precautions. You may block or report any user at any time.
Break the Ice lets you send another user an invitation - an offer to buy them a drink or food at the venue, or a message. Poursuit transmits only the invitation and the response. POURSUIT DOES NOT PROCESS, HOLD, TRANSMIT, OR FACILITATE ANY PAYMENT, DOES NOT COLLECT OR SHARE PAYMENT INFORMATION, AND IS NOT A PARTY TO ANY PURCHASE. POURSUIT IS NOT A BANK, MONEY TRANSMITTER, MONEY SERVICES BUSINESS, OR PAYMENT PROCESSOR. Anything you or another user choose to purchase happens at the venue, directly with the venue, under the venue's own terms.
Any purchase is voluntary. We are not responsible for and have no liability for any purchase or its consequences, and any dispute about a purchase is solely between the people and the venue involved.
The app may offer features intended to help you feel more comfortable or leave a situation — for example, a simulated ("fake") incoming call. THESE ARE CONVENIENCE TOOLS ONLY. THEY ARE NOT SAFETY OR SECURITY SERVICES, ARE NOT EMERGENCY SERVICES, AND ARE NOT A SUBSTITUTE FOR EITHER. They may fail, be delayed, or behave unexpectedly for reasons including device settings, permissions, silent or Do-Not-Disturb modes, battery state, hardware limits, or software errors. WE DO NOT WARRANT THAT ANY SUCH FEATURE WILL FUNCTION IN ANY PARTICULAR SITUATION AND ARE NOT LIABLE FOR ANY OUTCOME ARISING FROM YOUR RELIANCE ON IT. The app may also display references or links to third-party assistance resources, such as the 988 Suicide & Crisis Lifeline; we are not a provider of medical, mental-health, or emergency services, those resources are operated by third parties, and we are not responsible for their availability or for the outcome of contacting them. Location-sharing with a contact is likewise a convenience feature that depends on your device, network, and the recipient, may fail or be delayed, and is not a monitoring or protective service. In an emergency, contact local emergency services. You are solely responsible for your own safety.
You knowingly and voluntarily assume all risks associated with using Poursuit, including risks arising from inaccurate or incomplete information, from visiting venues, from the consumption of alcohol, and from interacting with or meeting other users. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE POURSUIT FROM ALL CLAIMS, DEMANDS, AND DAMAGES OF EVERY KIND ARISING OUT OF OR RELATED TO THOSE RISKS.
A "Verified" badge means a venue has claimed its listing and represented its own information to us. IT REFLECTS THE VENUE'S REPRESENTATION, NOT AN INDEPENDENT GUARANTEE BY POURSUIT. Verified information may still be inaccurate or out of date, and every disclaimer in these Terms applies equally to verified and unverified venues. A paid subscription does not affect a venue's ranking, ordering, or prominence in search results.
Poursuit links to and relies on third-party services (including mapping, reservations, and ride services) and references independently operated venues. We do not control and are not responsible for third-party services or venues, their availability, their content, their terms, or your dealings with them.
Poursuit, including its software, design, branding, and the compiled and derived data it presents, is owned by Foxx Designs LLC and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. You may not copy, scrape, redistribute, reverse-engineer, or create derivative works from the app or its data except as expressly permitted.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, FOXX DESIGNS LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES (THE "COMPANY") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE APP OR ANY INFORMATION IN IT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID THE COMPANY, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain exclusions or limitations; where that is the case, the above apply to the maximum extent permitted.
You agree to indemnify, defend, and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the app; your interactions or meetings with other users; anything you purchase for or receive from another user; your reliance on any information in the app; content you submit; or your violation of these Terms or of any applicable law or third-party right.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Except where prohibited by law, you and the Company agree to resolve any dispute relating to these Terms or the app through binding individual arbitration, rather than in court, and YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Either party may bring an individual claim in small-claims court if it qualifies. You may opt out of arbitration by emailing legal@poursuit.app within 30 days of first accepting these Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to Section 15, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
You may stop using Poursuit and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms or to protect the app or its users. Sections that by their nature should survive termination — including disclaimers, limitation of liability, release, indemnification, and dispute resolution — survive.
We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you in the app. Your continued use of Poursuit after a change means you accept the updated Terms.
